Tuesday, September 27, 2011, Regular Board of Trustee meeting

 

 

Official proceedings of the Board of Trustee’s, Town of Chatsworth, held in the Town Council room at 7:30 p.m.

 

Roll called showed the following present: President Haberkorn, Trustee Price, Birkenbeil, Runyon, Miller, Kubiak and Wiles. Also present was Attorney Weeks, Treasurer Gerdes-Hibsch and Zoning Commissioner Bartlett.

 

A motion by Trustee Miller and seconded by Trustee Price to approve the minutes of the previous meeting. Board of Trustee vote: 6 Yea

 

Sergeant Gragert reported there were 54 calls and 6 citations for the month of August. Trustee Wiles explained the possible change of speed limits in town from 30 mph unless otherwise posted to 25 mph unless otherwise posted. Sergeant Gragert asked if it passes when it will go into effect.

 

Lawyer’s report: Attorney Weeks reported there were letters sent out to the citizens that have ordinance violations that Ordinance Enforcement Officer Ledford gave to him. Ledford reported that the violation at 402 East Ash is being worked on and will most likely be completed by the end of the week.

 

Rick Phillips with Phillips and Associates gave the auditors report for fiscal year 2010/2011. He stated that the Town is losing money in the utility accounts (water/sewer/garbage) - expenses are higher than the income. He suggested that the Board look at rate increases soon. Trustee Miller said the committee has been looking at it and this is one of our topics tonight.

 

Trustee Wiles gave an over view of the Public Hearing held at 7 pm on the subject of speed limit change. The thought is to drop the limit on town streets to 25 mph unless otherwise posted.

A motion by Trustee Wiles and seconded by Trustee Runyon to write an amendment to the ordinance for all streets in The Town of Chatsworth jurisdiction to be changed to 25 mph unless otherwise posted.

Roll call: Trustees Price, Runyon, Wiles, Birkenbeil, Kubiak - yea / Trustee Miller - Nay

Vote: 5 Yeas, 1 Nay. Motion passed.

 

Demolition of house at 509 East Elm Street: Trustee Wiles read the bids for removal of house & shrub trees, level ground & hauling to land fill (land fill cost will be billed directly to the Town)

  Bid: J & J Machines $3500 for house/trees & $1000 to haul to landfill.

  Bid: Lee Farms Excavating $4500.

 We have not heard back from Livingston County Landfill what the cost estimate will be.

A motion by Trustee Wiles and seconded by Trustee Miller to except the bid from J & J Machines.

Urban Forestry Program: Trustee Runyon has been doing research on tree programs. The emerald ash boar has been found in Chenoa and it is just a matter of time before it gets here. We need an Urban Tree Program Ordinance in order to apply for any grants to help replace trees. We need to replace trees now not wait until we lose them. Runyon read the sample ordinance that he had created to the Board.

A motion by Trustee Runyon and seconded by Trustee Wiles to approve the ordinance #405 to establish an Urban Tree Program. Board of Trustee vote: 6 Yea

 

 

President Haberkorn, Trustee Runyon and Kubiak will be the Urban Tree Program Board members.

A motion by Trustee Miller and seconded by Trustee Birkenbeil to approve the appointments above.

Board of Trustee vote: 6 Yea

 

 

A motion by Trustee Runyon and seconded by Trustee Kubiak for boom rental for 1 month at a cost of $1350.00 plus $75.00 pick up and delivery for fall tree work to be done by Town Employees.

Board of Trustee vote: 6 Yea

 

Oak Street broken tile: Superintendent Ledford reported the tile has been fixed by putting in 20 feet of new tile.

 

A motion by Trustee Wiles and seconded by Trustee Birkenbeil to purchase the street signs need to be in compliance with IDOT at an approximate cost of $1600.00

Board of Trustee vote: 6 Yea

 

Sewer Plant update: will not drain properly, we had some sand work done and then jetted still not draining properly. Need to do more investigating.

 

A motion by Trustee Miller and seconded by Trustee Runyon to amend the water/sewer rates to be as follows: $10.00 meter fee - $3.00 per 1000 gallons water rate - $3.00 per 1000 gallons sewer rate per billing period.

Roll call: Trustees Miller, Wiles, Runyon, Price, Kubiak – yeas / Trustee Birkenbeil – Nay

Vote: 5 Yeas, 1 Nay. Motion passed.

 

The Town of Chatsworth received a check for $1200.00 from OK 2 Farms for road maintenance.

 

Trustee Kubiak: Attorney Weeks stay on top of these ordinance violations with Superintendent Ledford to these places cleaned up.

 

Trustee Runyon: The budget proposal is coming along good. Talked the Livingston County about the crossing guard they advise that we drop the money down to $50.00 just to keep the tax levy. I would like to see a couple of trees planted at 314 North 4th.

 

Trustee Wiles: The letters sent out by superintendent Ledford and Attorney Weeks are getting action. Several of the places are being work on. On the clean up at 410 East Hickory we had to bring in a second large dumpster. Clean up almost finished. Once complete would like to get our cost figured up to place a lien on the property.

 

Trustee Miller: On the house at 101 North 7th owner wants to know if she can put in separate meters in the basement and allow the Town permission to come in and shut off if the tenant does not pay.

A motion by Trustee Wiles and seconded by Trustee Kubiak the residence at 101 North 7th needs to be fixed by what the ordinance states.

 Board of Trustee vote: 4 Yea / 2 Nay

 

 

Zoning Commissioner asked the Board to increase the minimum charge for a permit to be changed to $25.00 to help cover the cost.

A motion by Trustee Runyon and seconded by Trustee Price to raise the minimum permit cost to $25.00

Board of Trustee vote: 6 Yea

 

 

Zoning Board also has 2 vacant seats; President Haberkorn said to bring some names of people to fill these seats within 90 days so we can get them filled.

 

 

A motion by Trustee Wiles and seconded by Trustee Birkenbeil to pay bills as presented and issue vouchers for same. Board of Trustee vote: 6 Yea

 

A motion by Trustee Miller and seconded by Trustee Kubiak to adjourn.
