Official proceedings of the Board of Trustee’s, Town of Chatsworth, held in the Town Council room at 7:30 p.m.
Roll called showed the following present: President Haberkorn, Trustee Price, Runyon, Birkenbeil, Miller, Wiles and Kubiak. Also present was Attorney Weeks, Treasurer Gerdes-Hibsch and Zoning Commissioner Bartlett.
A motion by Trustee Wiles and seconded by Trustee Birkenbeil to approve the minutes of the previous meeting. Board of Trustee vote: 6 Yea
Lawyer’s report: Attorney Weeks reported that Rail America wants $20,000 for the one time buy out of the lease.
He will have the transfer of deed done on the property at 509 East Elm tomorrow.
On the Rubinas property the town will have the full authority to go on the property to clean up the yard and front porch if he does not have it done by September 23, 2011.
Ordinance violations still pending will get with Ordinance Officer Ledford.
A motion by Trustee Miller and seconded by Trustee Runyon to un-table and pay for the line repair at 601 East Hickory at a cost of $350.00
Roll call: Trustees Price, Runyon, Wiles, Miller - Yea / Trustee Kubiak, Birkenbeil – Nay.
Vote: 4 Yeas, 2 Nays. Motion passed.
Speed reduction on City Streets: Trustee Runyon stated we need to act responsible in our community he presented a sample ordinance to the Board and asked that we think about this issue until the next meeting and discuss again. We should also petition Livingston County about 1st Street to lower the limit on the county road coming into town by the Cap’s Park District we have a lot of foot traffic there.
Gary Dohman asked if Family Affair Painting had liability insurance when working on the Town Hall. Trustee Kubiak explained that we did not request for liability insurance on the seal coating of the Town Hall building because it was a small job on the Towns property and could fall under the Towns insurance.
A motion by Trustee Birkenbeil and seconded by Trustee Kubiak to approve ordinance #404 Selcas Tax levy for $20,300.

President Haberkorn: Last weekends Fire Department fund raiser and the Tour De Chatsworth Bicycle Race were good for the Town. Had a good turn out and everyone had a good day.
Trustee Kubiak: Have received some information on a grant for tree replacement for trees damaged or killed by Ash Boar. There is a good chance we will have problems in the near future. The Board agreed and asked that he continue to look into programs for assistance. Trustee Birkenbeil said he talked with the USDA there have not been any found in Chatsworth yet but it probably is just a matter of time. Trustee Kubiak has been checking into boom rental possibly having Town Employees do the trimming on trees.
Trustee Runyon: Would like the Board to think about an ordinance for Urban Forestry Program, gave each Board member a sample ordinance to review for discussion and possible vote at the next board meeting.
Trustee Wiles: Once the deed transfer for 509 East Elm is done we will need to get down there and see what it is going to take to remove the house, checking into cost should have estimates at next meeting. 410 East Hickory property clean up - we will get a team together, dumpsters line up to start clean up after September 23, 2011 if owner does not have it done by that time. We will have a Sheriff Deputy there when we start to keep the peace. Once complete there will be a lien issued on the property for the expenses incurred by the Town of Chatsworth.
A motion by Trustee Wiles and seconded by Trustee Miller to get things lined up as stated above for clean up of 410 East Hickory Street to begin as soon as possible. Board of Trustee vote: 6 Yea
Trustee Birkenbeil: Superintendent Ledford gave a list of signs to be ordered. We will need 2 railroad, 2 left curve, 15 stop, 11 all way, 2 stop ahead, 6 - 25 mph unless posted, 2 deaf children, cost of approximately $1600. Talk with Superintendent Ledford before ordering, will review again next meeting.
Trustee Miller: Just jetting the sewer plant is not the answer. We need new sand first then jet. Good new sand is $27 per ton. We need to get more information. On Oak Street we have a broken tile that has to be fixed.
Letter to be sent to property owner of 101 North 7th street requiring the water service be updated to be in compliance with Chatsworth municipal code Chapter 9.1.10 – M.
Roll call: Trustees Miller, Birkenbeil, Wiles, Price, Kubiak – Yea / Trustee Runyon Nay. Vote: 5 Yeas 1 Nay. Motion passed.
Zoning Commissioner Bartlett gave copies of Zoning Board meeting held on September 12, 2011. A motion was approved by the Zoning Board to have a variance for Rodney Schlabowski to build a three car garage at 201 South 4th Street. A motion by Trustee Miller and seconded by Trustee Birkenbeil to approve the variance. Board of Trustee vote: 6 Yea
A motion was approved by the Zoning Board to allow the zoning change for Muhammad Malik at 33991 East 800 North Road from C1 to I2. A motion by Trustee Wiles and seconded by Trustee Runyon to reject the zoning change at this time. Roll call: Trustees Runyon, Wiles, Birkenbeil, Price, Kubiak – Nay / Trustee Miller Yea. Vote: 1 Yea – 5 Nays Motion failed.
The Town Board discussed the multiple ordinance violations that exist on both of his properties. Mr. Malik said he is working on the clean up at his business and can remove the unlicensed and no plate vehicles at his residence. Trustee Runyon told Mr. Malik when you bring your properties into compliance with the ordinances that exist now then you can come back and we will review this zoning change again.
President Haberkorn requested a motion to go into Executive Session at 8:45 pm Subject: Zoning Commission. A motion by Trustee Runyon and seconded by Trustee Kubiak to go into Executive Session on the above subject. Board of Trustee vote: 6 Yea
