TUESDAY, AUGUST 10, 2010 REGULAR BOARD OF TRUSTEE MEETING

 

OFFICIAL PROCEEDINGS OF THE BOARD OF TRUSTEE’S, TOWN OF CHATSWORTH, HELD IN THE TOWN COUNCIL ROOM AT 7:30 P.M.

 

ROLL CALL SHOWED THE FOLLOWING PRESENT;  PRESIDENT HABERKORN, TRUSTEES BIRKENBEIL, WILES, RUNYON, DILLER AND KUBIAK.

TRUSTEE MILLER SEATED AT 7:53 P.M.  ATTORNEY WEEKS, DEPUTY CLERK KERBER, TREASURER GERDES-HIBSCH AND CHATSWORTH ZONING COMMISSIONER BARTLETT PRESENT.

 

A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE BIRKENBEIL TO APPROVE THE MINUTES OF THE PREVIOUS MEETING.

ATTORNEY WEEKS SUBMITTED TRUSTEES THE FOLLOWING:

1)  3 LETTERS REGARDING MUNICIPAL CODE VIOLATIONS ON LOCATIONS

     A MOTION BY TRUSTEE RUNYON AND SECONDED BY TRUSTEE DILLER

     TO APPROVE ORDINANCE #393, AN ORDINANCE APPROPRIATING FOR

     ALL CORPORATE PURPOSES FOR THE TOWN OF CHATSWORTH,

     LIVINGSTON COUNTY, IL, FOR THE FISCAL YEAR BEING MAY 1, 2011,

     AND ENDING APRIL 30, 2012, IN THE AMOUNT OF $137,388.00.

     TO ADOPT ORDINANCE #394, AN ORDINANCE AMENDING CHAPTER 21

     OF THE MUNICIPAL CODE OF THE TOWN OF CHATSWORTH TO ADD

     ARTICLE 29, FENCES (REGULATIONS FOR FENCES IN ALL DISTRICTS)

     NO FENCE MAY BE ERECTED IN A RESIDENTIAL, COMMERCIAL OR

     INDUSTRIAL DISTRICT WHICH DOES NOT COMPLY WITH THE

     FOLLOWING ARTICLES 21.29.1 PERMIT, 21.29.2 FRONT YARD, 21.29.3

     PRIVACY FENCE, 21.29.4 SETBACKS, 21.29.5 HEIGHT, 21.29.6 ANCHORING

     AND 21.29.7 MATERIALS WITH THE FOLLOWING CHANGE TO THE

     ORDINANCE DRAFT OF 21.29.7 MATERIALS TO THE ORIGINAL DRAFT

     PREVIOUSLY PRESENTED, COVERING THIS ARTICLE.

REGARDING WALNUT/7TH STREET RESURFACING PROJECT - $434,619.68 HAS BEEN RECEIVED AND DEPOSITED TO MOTOR FUEL TAX FUND #116-610.

A MOTOR FUEL TAX FUND/WALNUT & 7TH PROJECT CHECKING ACCOUNT #188-786 HAS BEEN SET-UP TO SEPARATE THE PROJECT EXPENDITURES FROM THE 2010-11 MOTOR FUEL PROGRAM.

 

SIGNS FOR THE FY RURAL TRAFFIC SIGN UP-GRADE PROGRAM HAS BEEN RECEIVED. THESE NEW SIGNS WILL BE PLACED WHEN THE HARDWARE IS RECEIVED FROM THE LIVINGSTON COUNTY HIGHWAY DEPT.

 

A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE BIRKENBEIL TO ADOPT ORDINANCE 395, AN ORDINANCE AMENDING CHAPTER 10,

ARTICLE 3.39 GOLF CARTS - OPERATION OF GOLF CARTS ON CITY STREETS 

WHICH INCLUDES THE FOLLOWING REQUIREMENTS: 

1)  TWO HEADLIGHTS IN FRONT & 2 RED TAILLIGHTS IN BACK

2)  OWNER HAS PROOF OF LIABILITY INSURANCE AND MEETS THE 

     REQUIRED ILLINOIS SAFETY AND FAMILY FINANCIAL RESPONSIBILITY

3)  MUST BE OPERATED BY A PERSON WHO IS IN POSSESSION OF A VALID

     DRIVERS LICENSE

4)  NO GOLF CART MAY BE OPERATED IN THE TOWN OF CHATSWORTH ON 

     FIRST STREET FROM WALNUT STREET NORTH TO PINE STREET

 

BOARD OF TRUSTEE VOTE – 5 YEA

 

 

TRUSTEE MILLER SEATED AT 7:53 P.M.

 

JEFF MC MILLAN/GERDES-MC MILLAN INSURANCE PRESENTED THE TOWN INSURANCE RENEWAL PROPOSAL QUOTE FOR 2010-2011.  BOARD ALSO WAS GIVEN AN OPTION TO ADD EQUIPMENT BREAKDOWN COVERAGE AT AN ADDITIONAL COST OF $1499.00.

    A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE KUBIAK TO APPROVE THE GERDES-MC MILLAN PROPOSAL FOR INSURANCE COVERAGE OF LIABILITY, WORKERS COMP, PROPERTY PACKAGE AND INLAND MARINE IN THE AMOUNT OF $31,354.00, NOT ADDING THE ADDITIONAL OPTION OF EQUIPMENT BREAKDOWN COVERAGE AT

THIS TIME.

 

BOARD OF TRUSTEE VOTE – 6 YEA

 

PER TOWN OFFICE & TOWN PERSONNEL, ISSUES HAVE BEEN RAISED CONCERNING LARGE ROCKS PLACED ON TOWN STREET RIGHT OF WAY EASEMENTS, WHICH COULD BECOME A HAZARD FOR CITIZENS AND TOWN EMPLOYEES/EQUIPMENT.

    BOARD OF TRUSTEES AGREED TO SEND A COURTESY LETTER ON THESE ISSUES REQUESTING REMOVAL OF THE ROCK OR ROCKS.

 

PRESIDENT HABERKORN COMMENTED ON THE TP&W TRAIN DERAILMENT WHICH HAPPENED IN THE WEST END OF TOWN THIS DAY, AUGUST 10, 2010,

THE EXACT DAY THE FAMOUS TRAIN WRECK HAD HAPPENED EAST OF TOWN 123 YEARS AGO.

  

A MOTION BY TRUSTEE BIRKENBEIL AND SECONDED BY TRUSTEE MILLER TO APPROVE THE RENEWAL OF MOTOR FUEL TAX CD#3970 (12 MONTH CD) FOR 12 MONTHS AND RENEW MOTOR FUEL TAX CD#3972 & #4424 (6 MONTH CD’S) FOR 12 MONTHS.

A MOTION BY TRUSTEE KUBIAK AND SECONDED BY TRUSTEE MILLER TO PAY ½ OF THE $1,341.00 PHYSIO CONTROL ANNUAL SERVICE MAINTENANCE AGREEMENT BILL COVERING THE DEFIBULATORS IN THE AMOUNT OF $670.50.
