TUESDAY, APRIL 13, 2010 REGULAR BOARD OF TRUSTEE MEETING

 

OFFICIAL PROCEEDINGS OF THE BOARD OF TRUSTEE’S, TOWN OF CHATSWORTH, HELD IN THE TOWN COUNCIL ROOM AT 7:00 P.M.               

 

ROLL CALL SHOWED THE FOLLOWING PRESENT;  PRESIDENT HABERKORN,

TRUSTEES MILLER, BIRKENBEIL, WILES, RUNYON, DILLER & KUBIAK.

ATTORNEY WEEKS, TREASURER GERDES-HIBSCH AND CHATSWORTH ZONING COMMISSIONER BARTLETT PRESENT.

 

A MOTION BY TRUSTEE MILLER AND SECONDED BY TRUSTEE KUBIAK TO APPROVE THE MINUTES OF THE PREVIOUS MEETING.

 

BOARD OF TRUSTEE VOTE – 6 YEA

 

 

CORRESPONDENCE – LIVINGSTON COUNTY HAS RECEIVED A GRANT FROM THE ILLINOIS EMERGENCY MANAGEMENT AGENCY TO PREPARE AN ALL HAZARDS MITIGATION PLAN FOR THE COUNTY AND ALL INTERESTED MUNICIPALITIES.  THE HAZARD MITIGATION PLAN WILL MEET THE PLANNING REQUIREMENTS OF THE DISASTER MITIGATION ACT OF 2000 (DMA2000) AND OTHER PROGRAMS ADMINISTERED BY THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA).  EACH COMMUNITY HAS BEEN ASKED TO PARTICIPATE IN THE COUNTY'S PLANNING EFFORT BY ADOPTION OF A RESOLUTION AND THE APPOINTMENT OF ONE OR MORE PEOPLE TO SERVE ON THE MITIGATION COMMITTEE.

 

A MOTION BY TRUSTEE KUBIAK AND SECONDED BY TRUSTEE WILES TO APPROVE THE APPOINTMENT OF LORIE SHAFER & GALEN SCHAFFER TO REPRESENT OUR COMMUNITY AND RESOLUTION #390 FORMALIZING OUR INTEREST AND ASSISTANCE WITH THE PROJECT.

 

ATTORNEY WEEKS REPORTED THE FOLLOWING:

1)  RAILROAD SEWER LINE LEASE – FINALLY HAS HAD SOME CONTACT

     WITH THE RAILROAD ADMINISTRATION ON THE PENDING MATTER

TRUSTEE BIRKENBEIL REPORTED ON FOLLOWING ENGINEER MATTERS:

1)  WALNUT STREET BOX CULVERT REPLACEMENTS – JOINT AGREEMENT

      BETWEEN TOWN OF CHATSWORTH & LIVINGSTON COUNTY, IL HAS

      BEEN COMPLETED (APPROVED BY BOARD FOR SIGNATURE ON

      JANUARY 12, 2010)

2)  BLOOMER LINE RAILROAD HAS BEEN SENT CORRESPONDENCE

     REGARDING WALNUT STREET – REQUESTING BLOOMER LINE UP-GRADE     

     CROSSING AT THIS TIME

3)  TOWN OF CHATSWORTH  PARTICIPATING IN THE FY2009 RURAL LOCAL

      AGENCY TRAFFIC SIGN UP-GRADE PROGRAM – BID LETTING MAY 4,’10

4)  PINE STREET BRIDGE INSPECTION – COST WILL BE COVERED BY MOTOR

     FUEL TAX FUND 2010 PROGRAM

5)  MOTOR FUEL TAX FUND RESOLUTION FOR FISCAL YR 5/1/2010-4/30/2011 

     TO BE PRESENTED AT THE APRIL 13, 2010 BOARD MEETING

1)  FREEDOM OF INFORMATION OFFICIER YEARLY FEE

2)  GARBAGE CONTRACT & ORDINANCE #336 IN PART COVERING ARTICLE

      17.1.7 EXCESSSIVE WASTE COLLECTION & 17.1.10 COLLECTION OF SOLID

      WASTE (WHITE GOODS, JUNK, OVERSIZE ITEMS)

3)  LAKE OLIVER’S PROPOSAL TO PAY A PORTION OF MAINTENANCE COST

     PAID TO CHATSWORTH TOWNSHIP FOR MAINTENANCE OF 500 N ROAD

4)  FUELING OF TOWN EQUIPMENT – J & J INVESTMENTS HAS OFFERED TO

     ALLOW  TOWN OF CHATSWORTH EQUIPMENT TO BE FUELED UP  FROM

     THEIR DIESEL TANK.  TOWN WILL RECORD USAGE, REPLACING FUEL

     USED BY DIRECT ORDERING & BILLING FROM KEN’S OIL SERVICE

5)  MOWING NUISANCE LETTERS WILL BE SENT ON VACATED REAL

     ESTATE – IF TOWN HAS TO MOW THE PROPERTY IT WILL BE AT A COST

     OF $100.00 PER MOW

 

A MOTION BY TRUSTEE MILLER AND SECONDED BY TRUSTEE WILES TO SET THE “END OF YEAR / NEW YEAR MEETING” FOR THURSDAY,

APRIL 29, 2010 AT 7:00 P.M. TOWN HALL.

 

BOARD OF TRUSTEE VOTE – 6 YEA

 

 

PRESIDENT HABERKORN’S APPOINTMENT OF TRUSTEE RUNYON, MILLER AND DILLER AS A PERSONNEL SCREENING COMMITTEE HAD BEEN PUT IN PLACE TO SET UP THE JOB SPECIFICATIONS AND INTERVIEWING OF APPLICANTS TO TRAIN FOR THE DUTIES OF MUNICIPAL WATER COLLECTOR AND TOWN CLERK.  PUBLICATION HAS BEEN PUT IN THE DAILEY LEADER AND THE BLADE.  APPLICATIONS WILL BE ACCEPTED UNTIL APRIL 25, 2010 AT THE OFFICE OF THE CHATSWORTH TOWN CLERK.

 

CHATSWORTH ZONING COMMISSIONER BARTLETT SUBMITTED SEVERAL PRICE QUOTES ON THE PURCHASE OF A MEASURING WHEEL AND TAPE.

 

A MOTION BY TRUSTEE BIRKENBEIL AND SECONDED BY TRUSTEE DILLER TO PURCHASE A MEASURING WHEEL AT THE PRICE OF $69.00 AND A TAPE AT $25.00.  AFTER DISCUSSION THE FOLLOWING MOTION MADE:

 

A MOTION BY TRUSTEE RUNYON AND SECONDED BY TRUSTEE KUBIAK TO TABLE THE ABOVE MOTION UNTIL THE NEXT BOARD MEETING.

CHATSWORTH ZONING COMMISSIONER BARTLETT GAVE NOTIFICATION TO THE TOWN BOARD THAT THE CHATSWORTH ZONING BOARD OF APPEALS WOULD BE HOLDING PUBLIC HEARING/MEETING APRIL 20, 2010 AT 7:00 P.M. AT CHATSWORTH TOWN HALL RELATIVE TO A CHANGE OF TEXT TO THE ZONING ORDINANCE PERTAINING TO ASSESSORY BUILDINGS.

 

DISCUSSION FOLLOWED:  ZONING COMMISSIONER BARTLETT WILL PRESENT ZONING BOARD RECOMMENDATIONS AT THE NEXT TOWN BOARD MEETING.  ALSO PRESENTED A WRITTEN RESIGNATION FROM ALVIN TENNANT AS A MEMBER OF THE CHATSWORTH ZONING BOARD OF APPEALS EFFECTIVE APRIL 13, 2010.

 

A MOTION BY TRUSTEE MILLER AND SECONDED BY TRUSTEE BIRKENBEIL TO COVER THE COST OF $500.00 FOR REPAIR OF A BROKEN WATER SHUT OFF VALVE AT 305 E ELM.

STREET & ALLEY SUPT. LEDFORD PRESENTED A DUMP TRUCK BED LINER QUOTE FROM WALTER WORKS CONSISTING OF 3 COST OPTIONS RANGING FROM $2040.00 TO $2690.00.  BOARD REQUESTED SUPT. LEDFORD GET MORE PRICE QUOTES FROM OTHER VENDORS AND SUBMIT AT NEXT MEETING.

 

STEVE MAXSON/INTERIM WATER A SEWER EMPLOYEE STATED HE IS REGISTERED TO ATTEND THE WASTEWATER SHORT SCHOOL MAY 17-21, 2010.

 

A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE BIRKENBEIL TO AMEND CHAPTER 2 OF THE MUNICIPAL CODE OF THE TOWN OF CHATSOWRTH  -  2.1.3 MEETINGS -  AS FOLLOWS:  THE TOWN BOARD SHALL HOLD ITS REGULAR MEETINGS IN THE TOWN HALL ON THE SECOND AND FOURTH TUESDAY OF EACH MONTH AT 7:30 P.M.(CDT) COMMENCING ON MAY 1, 2010.
