Tuesday, February 28, 2012, Regular Board of Trustee meeting

 

 

Official proceedings of the Board of Trustee’s, Town of Chatsworth, held in the Town Council room at 7:30 p.m.

Roll call showed the following present: President Haberkorn, Trustee Miller, Price, Runyon, Wiles and Kubiak. Trustee Birkenbeil absent. Also present Attorney Weeks and Superintendent Ledford.

A motion by Trustee Miller and seconded by Trustee Price to approve the minutes of the previous meeting. Board of Trustee vote: 5 Yea

 

Sheriff’s Deputy Sergeant Gragert reported there were 36 calls and 11 citations. The Board asked that they watch for people going through resident’s garbage cans on the street. Gragert said he will report this to the county. People need to remember not to put any private or important information in their garbage unless shredded. Once put on the Town easement it is considered to be abandoned. If we can catch someone in the act then we can question them on why they are going through garbage and if they have dumped or spread garbage out then this can be addressed as littering or dumping.

 

Attorney Weeks report: There are times when we are in court that some Judges do not want to include Attorney Fees with the fine because it is not in the Town Ordinance. I have written an amendment to chapters 17 and 22 that if someone is found guilty the Court shall also assess any and all Costs and Attorney Fees. A motion by Trustee Miller and seconded by Trustee Runyon to approve the amended Ordinance. Board of Trustee vote: 5 Yea

Attorney Weeks gave copies of Consent to Demolish Residence forms for the abandon properties at 208 East Cherry, 612 East Locust and 210 East Cherry we have been working on. This would be the most cost effective if we can get the owners to agree. The Board asked that he go ahead and include houses at 202 East Spruce and 402 North 3rd Streets.

 

A motion by Trustee Miller and seconded by Trustee Wiles to approve the buy out agreement on the lease with Rail America for $10, 000. Board of Trustee vote: 5 Yea

 

A motion by Trustee Runyon and seconded by Trustee Price to sign with Illinois Department of Agriculture for the State of Illinois Emerald Ash Borer Compliance Agreement.

 Board of Trustee vote: 5 Yea

 

Trustee Miller has met with the Attorneys on returning the 500 road back to the Township and they are drawing up the papers.

President Haberkorn Report: Some of the problems with some properties in Town are showing improvements. 

 

Trustee Miller Report: There was a problem with a reader line inside a property; once this was discovered by the water department and fixed, it resulted in a large water bill for the resident. The resident has asked if there is anything we can do to help. I would like a Board decision if we can do the one time water adjustment per Ordinance #411. A motion by Trustee Wiles and seconded by Trustee Kubiak to follow Ordinance #411 and do the adjustment.

Trustee Miller stated this is why we need to really start thinking about meter replacement. These new meters that do not use readers and are radio read this would eliminate these type problems.

 

To replace all meters in town it would be approximately $100,000.00. The water committee will be meeting to get more facts and figures to present to the Board in the near future.

 

Trustee Runyon Report: Superintendent Maxson would like to sign up for the certification overview class with IRWA for his water operator’s license. The Board agreed we need to pay for any training they may need to get licensed.

 

A motion by Trustee Runyon and seconded by Trustee Miller to sell the lot at 509 East Elm.

Superintendent Ledford Report: Paul Brown Town Engineer may be at the next meeting with the MFT budget. 106 West Oak: Finally made contacted with the owner and gave him until March 8th to get the hole filled in or we will be turning this matter over to the Town Attorney. There needs to be some dirt work done at the dump that can not be done with the equipment that we have. Have talked with J&J machines and they said they could do it for around $500.00. A motion by Trustee Wiles and seconded by Trustee Miller to give Chad the permission to spend no more than $500.00 for the work.

A motion by Trustee Wiles and seconded by Trustee Miller to pay bills as presented and issue vouchers for same. Board of Trustee vote: 5 Yea
