TUESDAY, JANUARY 26, 2010 REGULAR BOARD OF TRUSTEE MEETING

 

 

OFFICIAL PROCEEDINGS OF THE BOARD OF TRUSTEE’S, TOWN OF CHATSWORTH, HELD IN THE TOWN COUNCIL ROOM AT 7:00 P.M.

 

ROLL CALL SHOWED THE FOLLOWING PRESENT;  PRESIDENT HABERKORN, TRUSTEES MILLER, BIRKENBEIL, WILES, RUNYON, DILLER AND KUBIAK.

ATTORNEY WEEKS, TREASURER GERDES-HIBSCH AND CHATSWORTH ZONING COMMISSIONER ABSENT.

 

A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE KUBIAK TO APPROVE THE MINUTES OF THE PREVIOUS MEETING.

BOARD VIEWED CORRESPONDENCE SENT BY ATTORNEY WEEKS PROVIDING A BRIEF SUMMARY OF FILES ON HAND:

 

1) RAILROAD SEWER LINE LEASE – PENDING – NO RESPONSE YET

 

2) ORDINANCE BOOK – DR. CAPASSO COULD HAVE ONE OF THE

    COMPUTER LABS DO THE SCANNING FOR THE TOWN AT A MINIMAL

    PRICE, IF ANY—BOARD REQUESTS ATTORNEY WEEKS FIND OUT WHAT

    MINIMAL IS

 

3) ZONING ORDINANCE AMENDMENT – CHANGE HEIGHT FROM 14 FEET

    TO 16 FEET – ATTORNEY WLL THEN APPROPRIATE PETITION AND SET

    THE MATTER FOR HEARING BEFORE THE ZONING BOARD OF APPEALS

 

4) FREEDOM OF INFORMATION ACT – INDIVIDUAL OR INDIVIDUALS TO

    TAKE THE ILLINOIS ATTORNEY GENERAL’S OFFICE ELECTRONIC

    TRAINING FOR FREEDOM OF INFORMATION COMPLIANCE – PENDING

 

5) DEMOLITION OF 509 E ELM – WAITING FOR CONTACT INFORMATION

    WITH RESPECT TO THE BRIDGEFORTH FAMILY TO SEE IF THEY WILL

    EXECUTE THE APPROPRIATE DEED TO THE TOWN SO THE STRUCTURE

    CAN BE DEMOLISHED – PENDING

 

TRUSTEE BIRKENBEIL REPORTED ON THE MEETING WITH AMEREN CIPS, PROPERTY OWNER MARK HENRICHS AND THE TOWN OF CHATSWORTH IN RESPECT TO THE RELOCATION OF ELECTRIC LINES RUNNING TO THE 2 COUNTRY WELLS.  AMEREN’S PENDING PLAN IS TO COME DOWN 4TH STREET AND AFTER CROSSING PINE PUT IN UNDERGROUND ALONG EAST SIDE OF PROPERTY OWNER MARK HENRICHS LANE UPON AGREEMENT OF AN EASEMENT.  ALSO PLAN TO HAVE THE ABILITY TO FEED ELECTRICITY TO THE COUNTRY WELLS 2 DIFFERENT WAYS, THE OTHER SOURCE ALONG

RAILROAD.

  

BOARD AGREED TO HAVE TRUSTEE BIRKENBEIL, STREET & ALLEY CHAIRPERSON, ORDER 6 LOADS OF CA-10 ROAD ROCK FOR MFT MAINTENANCE PROJECTS.

 

BOARD DISCUSSED OBTAINING A CASEY’S CREDIT ACCOUNT FOR GASOLINE FUEL NEEDS – ALSO DISCUSSED SEVERAL POSSIBLE OPTIONS REGARDING DIESEL FUEL NEEDS.  AT THIS TIME ALL FUEL NEEDS REQUIRE DRIVING OVER TO EVERGREEN FS AT FORREST WITH EACH VECHILE.

 

A MOTION BY TRUSTEE BIRKENBEIL AND SECONDED BY TRUSTEE MILLER TO RENEW MOTOR FUEL TAX CD’S  #003971 & #003972 ON THEIR MATURITY DATE OF 2-12-2010 FOR A 6 MONTH PERIOD.

 

BOARD OF TRUSTEE VOTE – 6 YEA

 

LIVINGSTON COUNTY SHERIFF’S DEPT/LT. GLOWACKI REPORTED 52 CALLS AND 13 CITATIONS ISSUED THE MONTH OF DECEMBER, 2009.

 

CORRESPONDENCE RECEIVED FROM JERRY KURTENBACH/LAKE OLIVER STATED THEY HAVE BEEN WORKING WITH A DEVELOPMENT/FINANCIAL TEAM OUT OF THE CLEVELAND AREA FOR ABOUT 6 WEEKS REGARDING THEIR INVOLVEMENT IN LAKE OLIVER.  HE WILL UP-DATE BOARD IN FEBRUARY ON THEIR PROGRESS.

 

DISCUSSED THE FOLLOWING ISSUES:

 

1)  ORDINANCE 17.1.7  EXCESSIVE WASTE COLLECTION – EXCESSIVE AMOUNTS OF REFUSE AND GARBAGE FROM HOUSEHOLD CLEANING OR MOVING - AN ADDITIONAL CHARGE SHALL BE DETERMINED BY GARBAGE COLLECTOR AND TOWN NOTIFIED TO BILL CUSTOMER THE ADDITIONAL CHARGE.

 

IF EXCESSIVE AMOUNT OF GARBAGE OR SOLID WASTE IS ACCUMULATED BY A PROPERTY OWNER’S TENANT, IT IS PROPERTY OWNER’S RESPONSIBILITY TO OBTAIN A DUMPSTER AND REMOVE THE GARBAGE  OR SOLID WASTE FROM PREMISES.  IF NOT COMPLETED IN A REASONABLE TIME, TOWN WILL INSTRUCT GARBAGE HAULER TO BRING IN A DUMPSTER AND THE FEE WILL BE BILLED TO THE REAL ESTATE OWNER.

 

2)  LIFT STATION TELEPHONES NOT WORKING – BOARD AGREED TO HAVE EMPLOYEE MAXSON CHECK WITH VERIZON TO REPAIR SINCE WE HAVE BEEN PAYING FOR INSIDE WIRE MAINTENANCE.

 

3)  PER PHONE CONVERSATION BETWEEN CHATSWORTH ZONING COMMISSIONER DOHMAN AND CLERK BIRKENBEIL - ZONING COMMISSIONER DOHMAN IS COMPLETING PRIOR PERMITS THAT HAVE NOT BEEN TURNED IN YET AND WILL TRY TO ATTEND THE FEBRUARY 9, 2010 BOARD MEETING TO DISCUSS POSITION STATUS.     

 

 

4)  A MOTION BY TRUSTEE MILLER AND SECONDED BY TRUSTEE WILES TO APPROVE THE PURCHASE OF A CHAIN HOIST AT AN APPROXIMATE PRICE OF $59.00.  BOARD OF TRUSTEE VOTE – 6 YEA

 

A MOTION BY TRUSTEE BIRKENBEIL AND SECONDED BY TRUSTEE DILLER TO PAY BILLS AS PRESENTED AND ISSUE VOUCHERS FOR SAME.
