TUESDAY, JANUARY 12, 2010 REGULAR BOARD OF TRUSTEE MEETING

 

OFFICIAL PROCEEDINGS OF THE BOARD OF TRUSTEE’S, TOWN OF CHATSWORTH, HELD IN THE TOWN COUNCIL ROOM AT 7:00 P.M.

 

ROLL CALL SHOWED THE FOLLOWING PRESENT;  PRESIDENT HABERKORN, TRUSTEES MILLER, BIRKENBEIL, WILES, RUNYON, DILLER AND KUBIAK.

ATTORNEY WEEKS AND TREASURER GERDES-HIBSCH PRESENT.  CHATSWORTH ZONING COMMISSIONER ABSENT.

 

A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE KUBIAK TO APPROVE THE MINUTES OF THE PREVIOUS MEETING.

 

BOARD OF TRUSTEE VOTE – 6 YEA

 

EMPLOYEE GARY KINNEY SUBMITTED A RELEASE FORM #676410 FROM THE SIU HEALTHCARE PLASTIC SURGERY INSTITUTE STATING HE MAY RETURN TO WORK ON 1/13/2010 WITH THE FOLLOWING RESTRICTION:  AS TOLERATED.  BOTH BOARD AND EMPLOYEE KINNEY AGREED TO HAVE GARY START BACK TO WORK ON A FULL TIME BASIS MONDAY, JANUARY 18, 2010.

 

ATTORNEY WEEKS REPORTED THE FOLLOWING:

1)  RAILROAD SEWER LINE LEASE RESPONSE – STILL PENDING

 

2)  CHATSWORTH ORDINANCE BOOK IS NOT ON COMPUTER IN COMPLETE

FORM SINCE COMPUTER PROGRAMS HAVE BEEN CHANGED SEVERAL

TIMES–WILL CHECK INTO COST OF SCANNING THE ORDINANCE BOOK

 

3)  IN PROCESS OF SETTING UP A ZONING HEARING FOR THE AMENDING OF

ZONING ORDINANCE REGARDING GARAGE HEIGHT

 

4)  SUBMITTED BOARD MEMBERS A COPY OF THE MUNICIPAL SUNSHINE    LAW REVISIONS FOR 2010.  EACH MUNICIPALITY MUST DESIGNATE EMPLOYEES, OFFICERS OR MEMBERS OF BOARD TO RECEIVE TRAINING ON COMPLIANCE WITH THE OPEN MEETINGS ACT.  A LIST OF THOSE DESIGNED TRAINEES MUST BE SUBMITTED TO THE PUBLIC ACCESS COUNSELOR AND EACH DESIGNATED PERSON MUST COMPLETE A TRAINING CURRICULUM DEVELOPED BY THE ATTORNEY GENERALS OFFICE BY JULY 1, 2010 AND ANNUALLY THEREAFTER.

 

5)  TRUSTEE WILES REQUESTED ATTORNEY WEEKS CONTACT THE SON THAT IS IN CHARGE OF THE BRIDGEFORTH ESTATE REGARDING  DEMOLITION OF THE PROPERTY AT 509 E ELM – AT THIS TIME TRUSTEE WILES HAS ONE DEMOLITION QUOTE OF THREE REQUESTED

 

A MOTION BY TRUSTEE BIRKENBEIL AND SECONDED BY TRUSTEE MILLER TO APPROVE AND AUTHORIZE PRESIDENT HABERKORN TO SIGN A PETITION WITH LIVINGSTON COUNTY HIGHWAY DEPT. FOR LOCAL IDOT FUNDS TO COVER THE COST OF ONE BOX CULVERT TO BE REPLACED ON THE WALNUT STREET EMERGENCY REPAIR PROJECT.

 

BOARD OF TRUSTEE VOTE – 6 YEA

 

PRESIDENT HABERKORN SIGNED THE FY2010 RURAL LOCAL AGENCY TRAFFIC SIGN UPGRADE PROGRAM MATERIAL PROPOSAL FROM LIVINGSTON COUNTY HIGHWAY DEPT, WHICH WILL HELP THEM SECURE THE FEDERAL FUNDING OF THIS PROGRAM.

 

GENE MAY/CENTRAL ILLINOIS DISPOSAL, INC. PRESENTED THE JANUARY 1, 2010 ILLINOIS LANDFILL RATE INCREASE AND THE PER MONTH (ANNUAL INCREASE) FOR GARBAGE PICK-UP AT A TOTAL MONTHLY INCREASE OF $185.45.

      A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE DILLER TO ACCEPT THE $185.45 PER MONTH COST INCREASE TO THE CURRENT MONTHLY GARBAGE CONTRACT AMOUNT OF $5,486.90 FOR A TOTAL MONTHLY AMOUNT OF $5,672.35 EFFECTIVE JANUARY 1, 2010.

(TOTAL ANNUAL COST FOR GARBAGE PICK-UP - $68,068.20)

 

A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE BIRKENBEIL TO TEMPORARILY SUSPEND FOR 6 MONTHS THE STICKER REQUIREMENT FOR LARGE ITEMS.

 

BOARD OF TRUSTEE VOTE – 5 YEA / TRUSTEE RUNYON - 1 NEY

      GENE MAY/CENTRAL ILLINOIS DISPOSAL, INC. AGREED THAT THE CURRENT CONTRACT FOR GARBAGE PICK-UP INCLUDES A ONE (1) TIME PER MONTH LARGE ITEM PICK-UP WHICH IS THE 4TH FRIDAY OF EACH MONTH.

 

A MOTION BY TRUSTEE RUNYON AND SECONDED BY TRUSTEE MILLER TO GIVE A $300.00 CONTRIBUTION TO SHOW BUS - PUBLIC TRANSPORTATION AVAILABLE  TO LIVINGSTON COUNTY RESIDENTS.

A MOTION BY TRUSTEE RUNYON AND SECONDED BY TRUSTEE KUBIAK TO DONATE $50.00 TO THE CHATSWORTH ELEMENTARY PTO THEME BASKET FUND RAISER OF WHICH ALL PROCEEDS WILL GO TO THE CHATSWORTH ELEMENTARY PTO FOR THE DIRECT EDUCATIONAL BENEFIT OF OUR CHATSWORTH STUDENTS.

TRUSTEE MILLER PRESENTED A REQUEST FROM EMPLOYEE MAXSON TO PURCHASE A NEW DRILL PACKAGE AT AN APPROXIMATE COST OF

$509.00.

      A MOTION BY TRUSTEE WILES AND SECONDED BY TRUSTEE KUBIAK  NOT TO APPROVE THE ABOVE REQUEST. 

 

BOARD OF TRUSTEE VOTE – 5 YEA / TRUSTEE RUNYON – 1 NEY

 

BOARD OF TRUSTEES DISCUSSED CHATSWORTH ZONING COMMISSIONER ISSUES.  TRUSTEE RUNYON WILL MAKE CONTACT WITH CURRENT ZONING COMMISSIONER MITCH DOHMAN REGARDING RETURN OF ALL ZONING MATERIALS.

      A MOTION BY TRUSTEE MILLER AND SECONDED BY TRUSTEE KUBIAK TO GO INTO EXECUTIVE SESSION ON THE ABOVE SUBJECT.
